Terms of Use

1. Definitions

“Site” means refreshandorganize.com and any sub-pages, portals, or mobile versions.

“Services” refers to all cleaning, organizing, carpet/upholstery cleaning, post-construction, Airbnb turnover, specialty add-ons, and any other labor or consulting offerings we provide.

“Client,” “you,” “your” refers to any individual or legal entity who accesses the Site or schedules Services.

“ROC,” “Company,” “we,” “us,” “our” refers to Refresh & Organize by Chelsie LLC, a California limited liability company.

2. Acceptance of Terms

By accessing the Site, booking Services, submitting payments, or signing any estimate, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use, plus our Booking Policy, Privacy Policy, Pricing & Fees Policy, and any other policy referenced herein (collectively, the “Agreement”). If you disagree with any part of the Agreement, refrain from using our Site or Services.

3. Changes to Terms

We may modify these Terms at any time. Material changes will be posted at least 10 calendar days before taking effect. The “Last Updated” date will change accordingly. Continued use after changes constitutes acceptance.

4. Eligibility & Jurisdiction

  • You must be at least 18 years old and able to form a legally binding contract to book Services.
  • Services are offered only within Fresno County and surrounding areas of California. Use of the Site is void where prohibited by law.
  • You warrant that any information you provide (address, square footage, payment method) is accurate and that you are duly authorized to engage and pay for the Services at that property.

5. Booking & Scheduling

  • >24 hours before service: free reschedule or cancel.
  • 12–24 hours: $25 reschedule fee or $50 cancellation fee.
  • <12 hours or on-arrival lock-out: 100 % of quoted total.

All fees will be charged to the card on file or invoiced immediately.

6. Service Scope & Limitations

Standard inclusions and exclusions are detailed on each Service page. The following universal limitations apply:

  • We do not handle biohazards (human/animal waste, mold >10 sq ft, needles) without prior written agreement and additional fees.
  • High-risk tasks (ladder work >10 ft, exterior window washing above ground floor) require pre-approval and may incur an OSHA compliance surcharge.
  • Organizing sessions include guidance but do not constitute legal, medical, or financial advice.
  • Post-construction cleans assume a job site free of active construction teams and with electricity and water restored.

7. Pricing, Estimates & Payment

7.1 Flat-Rate Pricing

Publicly posted price lists (bed/bath, square footage, add-ons) form the basis of your estimate. Actual charges may adjust if:

  • Square footage is understated by >10 % (verified via Zillow, county assessor, or laser measurement);
  • The home condition requires additional labor (e.g., excessive clutter, grease, or pet hair); or
  • You request extra services after booking.

7.2 Pre-Authorization & Capture

  • A pre-authorization hold equal to the quoted amount is placed 24 hours before service.
  • The card is captured only after job completion and digital approval (CompanyCam walk-through or Client signature).
  • Declined holds must be resolved within 4 hours of notice or the appointment is subject to cancellation.

7.3 Late Payments & Chargebacks

  • Balances left unpaid for 24 hours incur a $35 admin fee plus 1.5 % interest per month.
  • Initiating a chargeback without first following the Section 21 dispute process is breach of contract. You will be liable for collection costs and reasonable attorneys’ fees.

8. Arrival Window

We commit to a 2-hour arrival window (e.g., 8–10 AM). Extreme traffic or prior-job overages may shift this window; we notify you ASAP by call or SMS. Failure to provide timely entry results in a lock-out fee equal to the full service charge.

9. The Refresh Promise (Satisfaction Guarantee)

If you are not delighted, notify us during the final walk-through or within 4 hours of receiving your photo report. We will re-clean the identified area at no cost within 24 hours. Beyond that window, issues are treated as new service requests. This guarantee does not cover:

  • Pre-existing damage or permanent stains;
  • Areas not included in your selected service level;
  • Surfaces we advised could not be safely cleaned (e.g., flaking paint, broken blinds).

10. Breakage, Damage & Loss

We carry general liability insurance, but our liability is limited to repair or replacement of damaged items up to the lesser of (a) $500 or (b) the total cost of that day’s service, unless the damage results from gross negligence or willful misconduct.

Report incidents in writing (with photos) within 24 hours to hello@refreshandorganize.com. Unreported claims are waived.

11. Surcharges, Add-Ons & Specialty Fees

Current add-on prices (e.g., oven $35, fridge $35, interior windows $50) are published on our price list. Holiday (federal holidays), after-hours (starts before 7 AM or after 7 PM), or emergency bookings (<24 hours) incur a 25–50 % surcharge subject to crew availability. Homes with pets incur a $50 pet-hair & filter surcharge.

12. Recurring Service Discounts

Weekly, bi-weekly, and monthly discounts (20 %, 15 %, 10 %) apply after completion of an initial Deep Clean and continue only while you maintain an active card on file. Skipped visits or failed payments void the discount until the next catch-up or Deep Clean resets the schedule.

13. Client Responsibilities

  • Provide unobstructed access to the property (keys, codes, gate remotes).
  • Ensure utilities (water, electricity, HVAC) are operational.
  • Secure or remove valuables, fragile collectibles, firearms, and sensitive documents.
  • Disclose known hazards (pests, biohazards, asbestos, lead paint, aggressive animals).
  • Report issues promptly to allow us to remedy them.

14. Pets, Safety & Work Environment

We love pets but require that any animal with territorial tendencies be kenneled or removed during service. We reserve the right to discontinue work if safety is compromised by animals, occupants, or environmental hazards.

15. Intellectual Property

All Site content, logos, service marks, photos (including CompanyCam images), videos, pricing tools, and custom graphics are the intellectual property of ROC or its licensors. Replication, distribution, or derivative use is prohibited without express written consent.

16. User Content & Reviews

By submitting reviews, testimonials, or media, you grant ROC a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, and display such content in any media for promotional or educational purposes.

We may moderate or remove content that is defamatory, obscene, deceptive, or unrelated to our Services.

17. Privacy & Data Security

Your use of the Site is also governed by our Privacy Policy. California residents may exercise CCPA rights as described therein. ROC employs SSL, encrypted payment processing, and role-based data access to safeguard personal information.

18. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available.” ROC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, nor that all soils, stains, or odors can be removed.

19. Limitation of Liability

To the fullest extent permitted by California law, ROC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the Site or Services, even if advised of the possibility of such damages. Our aggregate liability shall not exceed the greater of (a) $500 or (b) the total amount you paid for the Services giving rise to the claim.

20. Indemnification

You agree to defend, indemnify, and hold harmless ROC, its owner Chelsie, helpers, contractors, affiliates, and insurers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of the Agreement, negligence, or willful misconduct.

21. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of California without regard to conflict-of-law principles.

Mandatory Mediation & Arbitration. Any dispute shall first be submitted to good-faith mediation in Fresno County. If unresolved within 30 days, the matter shall be settled by binding arbitration under the JAMS Streamlined Rules. Each party bears its own costs; the prevailing party may recover reasonable attorneys’ fees. You waive any right to trial by jury and to participate in class actions.

22. Miscellaneous

  • Force Majeure. ROC is not liable for delays or failure to perform due to events beyond our reasonable control (e.g., natural disasters, pandemics, labor strikes).
  • Severability. If any provision is held invalid, the remaining provisions remain in full force.
  • No Waiver. Our failure to enforce any provision is not a waiver of future enforcement.
  • Entire Agreement. These Terms, plus referenced policies, constitute the entire agreement between you and ROC and supersede all prior understandings.
  • Assignment. You may not assign your rights or obligations without our written consent. We may assign this Agreement in connection with a merger or sale of assets.
  • Electronic Communications. You consent to receive communications electronically and agree that electronic signatures have the same force as handwritten signatures.
